These Terms & Conditions (“Agreement”) govern your access to and use of our website, mobile applications, and related services (collectively, the “Services”). By using our Services, you agree to be legally bound by this Agreement. If you do not agree, you must stop using the Services.

By using our Services, you agree to comply with this Agreement. If you are accessing the Services on behalf of a company, landlord, or property management entity, you represent that you have authority to bind that entity, and “you” will apply to that entity as well.

We may update these Terms from time to time. If changes are made, we will post the revised version on our website or notify you by other reasonable means. Eligibility and Accounts
Eligibility: You must be at least 18 years old and a resident of the United States to use our Services.

Services Provided
Prime American Living offers an online platform that:
Allows landlords and property managers to list rental properties.
Allows renters to search and connect with available properties.
Facilitates referral-based rewards when renters sign a lease with participating landlords through our platform.
Rewards Program
Certain landlords may agree to pay a referral fee to Prime American Living, which may be shared with renters as referral rewards.
Rewards are not guaranteed and depend on landlord participation.
Rewards may not be sold, transferred, bartered, or exchanged.
If a renter fails to complete a lease agreement or meet the eligibility conditions, they may forfeit their reward.
Disclaimer: Prime American Living does not guarantee that any property listing is accurate, available, or that any landlord will offer referral rewards. We do not own or manage rental properties.

Taxes
You are solely responsible for any applicable federal, state, or local taxes related to referral rewards or other payments you may receive.

User Obligations
When using the Services, you agree to:
Provide accurate and truthful information.
Use the Services only for lawful purposes (e.g., searching for or listing rental properties).
Not interfere with the operation of the platform or misuse property listings.
Comply with all applicable housing, rental, and consumer protection laws.

Feedback
If you submit feedback, ideas, or suggestions, you grant us a perpetual, worldwide, royalty-free license to use them for any purpose without obligation to compensate you.

Ownership & Intellectual Property
Prime American Living retains all rights, title, and interest in the Services,including content, trademarks, and technology.
You may not reproduce, distribute, or create derivative works from platform materials except as necessary for your personal use of the Services.
You retain ownership of content you submit (such as listings), but by uploading it, you grant us a license to use, display, and share it as needed to provide the Services.

Prohibited Activities
You agree not to:
Post false, misleading, or fraudulent property listings or applications.
Upload offensive, illegal, or infringing content.
Attempt to hack, scrape, or disrupt the platform.
Collect personal information of other users without consent.
Use the platform for purposes unrelated to rental housing or referrals.
We reserve the right to suspend or terminate accounts that violate these Terms.

Our Services may link to third-party websites. We are not responsible for their content, services, or practices. Use them at your own risk.

Termination
We may suspend or terminate your access to the Services at any time, without notice, for conduct that we believe violates these Terms or is harmful to our platform or users.

The Services are provided “as is” and “as available” without warranties of any kind, express or implied. We do not guarantee uninterrupted access, error-free operation, or the accuracy of property listings.

Limitation of Liability
To the fullest extent permitted by law:
Prime American Living is not liable for indirect, incidental, or consequential damages, including loss of profits, opportunities, or data.
Our total liability for any claims related to your use of the Services will not exceed $100 or the amount you paid to us (if any), whichever is greater.

You agree to indemnify and hold harmless Prime American Living, its officers, employees, and partners from any claims, damages, or expenses arising from:
Your use of the Services;
Content you submit (e.g., property listings);
Your violation of these Terms or applicable laws.

Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Indiana, without regard to conflict-of-law principles.
Arbitration Agreement
Any disputes arising from these Terms or your use of the Services shall be resolved through binding individual arbitration under the rules of the American Arbitration Association (AAA). You waive the right to participate in class actions.
Exceptions: You may bring a claim in small claims court if eligible, or seek injunctive relief to protect intellectual property.

General Terms
Entire Agreement: These Terms, along with our Privacy Policy, form the entire agreement between you and Prime American Living.
Severability: If any provision is found invalid, the rest remain enforceable.
Assignment: You may not transfer your rights under this Agreement; we may assign ours.
Force Majeure: We are not responsible for delays or failures caused by events beyond our control (natural disasters, government actions, internet outages, etc.).
